These Terms of Service constitute a legally binding agreement governing the use of the website, digital platforms, and courier, logistics, and transportation services (collectively, the “Services”) provided by AllenExpress24 (“AllenExpress24,” “we,” “us,” or “our”).

By accessing our website, booking a shipment, or using our Services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must refrain from using the Services.

1. Legal Basis of Carriage

All services provided by AllenExpress24 constitute a contract of carriage and are subject to:

• Applicable international conventions, including the Montreal Convention (1999) and, where applicable, the Warsaw Convention and related protocols
• Mandatory national laws and consumer protection regulations that cannot be excluded by contract

Where there is a conflict, mandatory international or national law shall prevail.

2. Definitions

• “Shipment”: Any document, parcel, cargo, or item accepted by AllenExpress24 for transport.
• “Sender”: The individual or entity tendering the Shipment.
• “Recipient”: The intended consignee of the Shipment.
• “Declared Value”: The value declared by the Sender for liability or insurance purposes.
• “Special Drawing Rights (SDR)”: An international monetary unit defined by the International Monetary Fund used to calculate liability limits.

3. Scope of Services

AllenExpress24 provides domestic and international courier, express delivery, freight forwarding, and logistics services via air, road, sea, or multimodal transport, subject to operational availability.

AllenExpress24 reserves the right to subcontract transportation to third-party carriers without notice.

4. Customer Obligations

The Sender represents and warrants that:

1. The Shipment contents are lawful and accurately described.
2. The Shipment is properly packed to withstand ordinary transport risks.
3. All documentation, customs declarations, invoices, licenses, and permits are complete and accurate.
4. The Sender complies with all export, import, customs, sanctions, and trade control laws.

The Sender shall indemnify AllenExpress24 for any loss, damage, penalty, or expense arising from breach of these obligations.

5. Prohibited and Restricted Items

Unless expressly agreed in writing, AllenExpress24 will not accept:

• Illegal or prohibited goods under any applicable law
• Dangerous goods as defined by IATA / ICAO / ADR regulations
• Explosives, firearms, weapons, ammunition
• Narcotics or controlled substances
• Live animals or perishable goods without prior approval
• Cash, precious metals, gemstones, or negotiable instruments

AllenExpress24 may inspect, refuse, abandon, destroy, or surrender such items to authorities without liability.6. Pricing, Payment, and Charges

• Charges are calculated based on weight, volume, destination, and service level.
• All charges must be paid in advance unless otherwise agreed in writing.
• Customs duties, taxes, storage fees, fines, and governmental charges are payable by the Sender or Recipient.

AllenExpress24 reserves the right to withhold delivery until all outstanding amounts are settled.

7. Transit Times and Delivery

Delivery times are estimates only and are not guaranteed.

AllenExpress24 is not liable for delays caused by:

• Customs inspections or seizures
• Force majeure events
• Incomplete documentation
• Acts or omissions of third parties
• Government actions or regulatory compliance

8. Inspection and Security

AllenExpress24 reserves the right to open, inspect, X-ray, or scan Shipments at any time to comply with security, safety, or regulatory requirements. Inspection does not reduce the Sender’s responsibility.

9. Liability for Loss, Damage, or Delay

9.1 International Air Carriage

Where carriage is performed by air and subject to the Montreal Convention (1999) or Warsaw Convention, AllenExpress24’s liability is limited in accordance with those conventions, currently up to 19 SDR per kilogram, unless a higher value is declared and accepted in writing.

9.2 Other Modes of Transport

Where international conventions do not apply, liability shall be limited to the lesser of:

• The actual value of the Shipment, or
• The maximum amount permitted under applicable law.

9.3 Excluded Losses

AllenExpress24 shall not be liable for:

• Indirect, consequential, or economic losses
• Loss of profits, market, or reputation
• Damage caused by inadequate packaging or inaccurate declarations

10. Declared Value and Insurance

Shipment insurance or declared value coverage is available upon request and payment of an additional charge at the time of booking.

If no declared value or insurance is purchased, the Shipment travels at the Sender’s risk, subject only to the liability limits stated herein.

11. Claims and Time Limits

• Claims for damage or loss must be submitted in writing within 14 days of delivery.
• Claims for delay must be submitted within 21 days.
• Any legal action must be brought within 2 years, in accordance with international conventions.

Failure to comply with these time limits extinguishes the right to claim.

12. Customs and International Shipments

For international Shipments, the Sender authorizes AllenExpress24 to act as agent for customs clearance purposes.

The Sender remains fully responsible for:

• Accuracy of customs declarations
• Payment of duties, taxes, and penalties
• Compliance with import/export restrictions

AllenExpress24 is not responsible for customs delays, seizures, or refusals.

13. Force Majeure

AllenExpress24 shall not be liable for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, pandemics, war, labor disputes, or governmental actions.

14. Intellectual Property

All website content, trademarks, logos, and intellectual property belong exclusively to AllenExpress24 and may not be used without prior written consent.

15. Privacy and Data Protection

Personal data is processed in accordance with applicable data protection laws and the AllenExpress24 Privacy Policy.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of new york city, subject to mandatory international conventions.

Any dispute shall be submitted to the exclusive jurisdiction of the courts of New York Supreme Court., unless otherwise required by applicable law.

17. Amendments

AllenExpress24 reserves the right to amend these Terms at any time. Continued use of the Services constitutes acceptance of the amended Terms.
